​Terms and conditions (“Terms”) are a set of legal terms defined by the owner of a website. They set forth the terms and conditions governing the activities of the website visitors on the said website and the relationship between the site visitors and the website owner. ​​

​When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item, and you complete the check-out payment process. The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. “The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Shipping And Fulfillment Policy:

Delivery times above include production and shipping. Delivery times for orders made after 6pm ET will be calculated from the next business day.

For high-volume orders, additional fees will be applied to shipping costs for the following items:

  • Flyers (quantities of 5,000+)

  • Brochures (quantities of 5,000+)

  • Presentation folders (quantities of 2,000+)

You’ll see the final fee calculation in your cart before you make your purchase.

Exceptions: Some products and destinations are not available in all shipping speeds. Most, but not all, of these are listed right here.

  • Clothing & bags: 10+ business days

  • Promotional products: 10+ business days

  • Photobooks:: 6 or 8 business days

  • Sample kits: 14 business days

  • Checks: 6 or 8 business days

  • Note: For security purposes, checks can only be shipped to the address printed on the check – and they cannot be sent to P.O. boxes

If your order includes products with different shipping speeds, it can be split into separate packages. This avoids delaying products that you can receive sooner.

You'll have a choice of shipping speeds, depending on which products are in your cart. For example, if some of your items are available for express shipping, you will be able to choose this option. You only need to select and pay for one speed.

Before you make the payment, we’ll show you how your order will be split and the estimated date that each product will be delivered to you. This means you’ll know prior to purchase which products in your cart may arrive later than your chosen delivery speed.

Available International Destinations: Austria, Belgium, Switzerland, Czech Republic, Germany, Denmark, Spain, Finland, France, Greece, Ireland, Iceland, Netherlands, Norway, Poland, Portugal, Sweden, Italy and the United Kingdom.

Return and Refund Policy:

For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: Apparel Items. 

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Warranty: When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

Ownership:

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Heart In Jesus. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

You agree to indemnify and hold [website owner] harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitations Of Liability:

To the maximum extent permitted by applicable law, in no event shall [website owner], be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, [website owner] assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right To Change And Modify Terms:

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

Preference Of Law And Dispute Resolution:

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [Name of Country / State], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in [Name of the city of the courts]. Charge Backs: A chargeback is a demand by a credit card provider for a merchant to return the funds to a consumer, following a fraudulent or disputed transaction.

User Communities: Terms clarify that all users that join a community have a public profile that is publicly visible to site visitors, and that their public activity (such as their posts or comments) will be visible to other visitors of the website.

A user of the website can always opt-out and exit the community, and upon doing so, such user’s profile will not be publicly visible. Naturally, in such event the user will not be able to use the community features (e.g. liking, commenting or writing posts).

Donations/Contributions:

[Heart In Jesus Corportation] urges all prospective donors to seek the assistance of personal legal and financial advisors in matters relating to their gifts, including the resulting tax and estate planning consequences. The following policies and guidelines govern acceptance of gifts made to [Heart In Jesus Corportation] for the benefit of any of its operations, programs or services. Use of Legal Counsel—[Heart In Jesus Corportation] will seek the advice of legal counsel in matters relating to acceptance of gifts when appropriate. Review by counsel is recommended for: A. Gifts of securities that are subject to restrictions or buy-sell agreements. B. Documents naming [Heart In Jesus Corporations trustee or requiring [Heart In Jesus Corportation] to act in any fiduciary capacity. C. Gifts requiring [Heart In Jesus Corportation to assume financial or other obligations. D. Transactions with potential conflicts of interest. E. Gifts of property which may be subject to environmental or other regulatory restrictions. Restrictions on Gifts—[Heart In Jesus Corportation] will not accept gifts that (a) would result in [Heart In Jesus Corportation] violating its corporate charter, (b) would result in [Heart In Jesus Corportation] losing its status as an IRC § 501(c)(3) not-for-profit organization, (c) are too difficult or too expensive to administer in relation to their value, (d) would result in any unacceptable consequences for [Heart In Jesus Corportation], or (e) are for purposes outside [Heart In Jesus Corportation]’s mission. Decisions on the restrictive nature of a gift, and its acceptance or refusal, shall be made by the Executive Committee, in consultation with the Executive Director. Gifts Generally Accepted Without Review— 3 Cash. Cash gifts are acceptable in any form, including by check, money order, credit card, or on-line. Donors wishing to make a gift by credit card must provide the card type (e.g., Visa, MasterCard, American Express), card number, expiration date, and name of the card holder as it appears on the credit card. Marketable Securities. Marketable securities may be transferred electronically to an account maintained at one or more brokerage firms or delivered physically with the transferor's endorsement or signed stock power (with appropriate signature guarantees) attached. All marketable securities will be sold promptly upon receipt unless otherwise directed by [Heart In Jesus Corportation]’s Investment Committee. In some cases marketable securities may be restricted, for example, by applicable securities laws or the terms of the proposed gift; in such instances the decision whether to accept the restricted securities shall be made by the Executive Committee. Bequests and Beneficiary Designations under Revocable Trusts, Life Insurance Policies, Commercial Annuities and Retirement Plans. Donors are encouraged to make bequests to [Heart In Jesus Corportation] under their wills, and to name [Heart In Jesus Corportation] as the beneficiary under trusts, life insurance policies, commercial annuities and retirement plans. Charitable Remainder Trusts. [Heart In Jesus Corportation] will accept designation as a remainder beneficiary of charitable remainder trusts. Charitable Lead Trusts. [Heart In Jesus Corportation] will accept designation as an income beneficiary of charitable lead trusts. Gifts Accepted Subject to Prior Review—Certain forms of gifts or donated properties may be subject to review prior to acceptance. Examples of gifts subject to prior review include, but are not limited to: Tangible Personal Property. The Executive Committee shall review and determine whether to accept any gifts of tangible personal property in light of the following considerations: does the property further the organization’s mission? Is the property marketable? Are there any unacceptable restrictions imposed on the property? Are there any carrying costs for the property for which the organization may be responsible? Is the title/provenance of the property clear? Life Insurance. [Heart In Jesus Corportation] will accept gifts of life insurance where [Heart In Jesus Corportation] is named as both beneficiary and irrevocable owner of the insurance policy. The donor must agree to pay, before due, any future premium payments owing on the policy. Real Estate. All gifts of real estate are subject to review by the Executive Committee. Prior to acceptance of any gift of real estate other than a personal residence, [Heart In Jesus Corportation] shall require an initial environmental review by a qualified environmental firm. In the event that the initial review reveals a potential problem, the organization may retain a qualified environmental firm to conduct an environmental audit. Criteria for acceptance of gifts of real estate include: Is the property useful for the organization’s purposes? Is the property readily marketable? Are there covenants, conditions, restrictions, reservations, easements, encumbrances or other limitations associated with the property? Are there carrying costs (including insurance, property taxes, mortgages, notes, or the like) or maintenance expenses associated with the property? Does the environmental review or audit reflect that the property is damaged or otherwise requires remediation?
